Terms of Service

Talkable lets you connect messaging platforms (currently Telegram, Instagram, and Facebook Messenger), upload or import a catalog of products or services, and configure an AI assistant that reads that catalog and your own instructions to reply to customer messages, draft orders, request payment, and verify payment receipts. Talkable also lets you invite team members to a shared project, connect payment methods (currently the Idram and Telcell wallets and ARCA card transfers), and import data from third-party sources such as Google Sheets, Google Docs, and Google Drive.

Talkable is a tool that automates messaging and order-drafting on your behalf. It is not a marketplace, payment processor, escrow service, or party to any sale between you and your customers.

You need an account to use Talkable. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that happens under your account. Tell us right away if you suspect unauthorized use of your account.

A Talkable account belongs to one or more "projects", each representing a business. Project owners can invite other users as admins or collaborators and can remove them; each role has different permissions inside the project, described in the product itself.

Talkable integrates with third-party platforms you choose to connect, including Telegram, Meta's Instagram and Facebook platforms, Google, and the Idram and Telcell payment services. When you connect one of these, you authorize Talkable to access and act on that account on your behalf, strictly to provide the functionality you configure (for example, sending and receiving messages, reading your product data, or generating a payment QR code).

Your use of each connected platform remains subject to that platform's own terms of service and policies, including Meta's Platform Terms and Developer Policies where you connect an Instagram or Facebook account. You are responsible for complying with those third-party terms, and for having the rights needed to connect any account, page, or platform you link to Talkable. We may lose access to a connected account if you revoke authorization on the third-party platform, or if the platform changes or restricts its API, and Talkable is not responsible for functionality that breaks as a result.

"Your Content" means anything you or your team upload or connect to Talkable: product data, images, persona and configuration instructions, uploaded receipts, and any other material you provide. You retain ownership of Your Content. You grant Talkable a license to host, process, and transmit Your Content solely to operate the Service for you, including sending it to the third-party providers described in our Privacy Policy (for example, an AI provider used to generate replies) as needed to answer a customer message.

You are solely responsible for Your Content: that you have the rights to use and share it, that it is accurate, and that it complies with applicable law and with the policies of every platform you connect (including Meta's Commerce Policies and Community Standards where relevant).

Talkable's assistant uses an AI model to generate replies, draft orders, detect language, and evaluate uploaded payment receipts, based on Your Content and the instructions you provide. AI-generated output can be incomplete, out of date, or simply wrong. You are responsible for reviewing your assistant's configuration, monitoring its conversations, and confirming order and payment decisions before relying on them. Talkable's automatic receipt check, in particular, is a first-pass filter, not a substitute for you confirming a payment actually arrived before marking an order paid or shipping it.

When enabled, Talkable's assistant can draft an order from a conversation and send your customer the payment instructions or QR code for a payment method you have enabled (Idram, Telcell, an ARCA card transfer, cash on delivery, or pay in person). Talkable does not hold, transmit, or have custody of funds at any point, since payments happen directly between you and your customer through the payment method you chose. You are responsible for your relationship with your customers, including fulfillment, refunds, and disputes.

Talkable is a paid service. Your first project starts on a 14-day trial on Basic limits, one trial per account, and after that creating a project requires a paid plan. Plans, prices and limits are shown in-product on your project's Billing & Usage page. Subscriptions are sold by Paddle.com Market Ltd as merchant of record, which issues your invoices and carries out any refund we approve. Fees are billed in advance for the applicable billing period, and our Refund Policy sets out when a payment is refunded and how to ask. We may change our plans or pricing; where we do, we will give you reasonable notice before it applies to you.

You agree not to use Talkable to:

• Sell or promote illegal goods or services, or anything prohibited by a connected platform's own policies (for example, Meta's Commerce Policies on Instagram and Facebook);
• Send spam, unsolicited bulk messages, or phishing content;
• Attempt to circumvent a connected platform's messaging window, rate limits, or other technical restrictions;
• Upload content that infringes someone else's intellectual property or violates their privacy;
• Probe, scan, or attempt to disrupt Talkable's infrastructure or bypass its access controls; or
• Use the Service in a way that violates applicable law.

Talkable and its underlying software, design, and branding belong to us and our licensors. These Terms do not grant you any rights to Talkable's intellectual property beyond what is needed to use the Service as intended.

You may stop using Talkable and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, including the Acceptable Use section, or if required by a connected platform's own policies. On termination, we will handle Your Content as described in our Privacy Policy.

Talkable is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service, or any AI-generated output, will be uninterrupted, error-free, or accurate.

To the maximum extent permitted by law, Talkable and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service, including losses arising from an AI-generated reply, a missed message, or a payment dispute with your customer. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the claim arose.

We may update these Terms from time to time. If we make a material change, we will provide reasonable notice, such as an in-product notice or an email to the address on your account. Continued use of Talkable after a change takes effect means you accept the updated Terms.

These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
